| A
property, which can be a simple logo (Nike swoosh), may be
licensed to manufacturers of various products who then
utilize the logo or property on their products. The owner
of the property receives a negotiated percentage of all
gross sales of the particular product. The manufacturer
may offer up front monies or guarantees of minimum sales
as part of the licensing agreement.
Entertainment
and sports related licensed properties account for
Billions of dollars in gross sales throughout the world.
Considering that the National Football League alone
accounts for over $4 Billion Dollars in gross sales of
licensed products, Billions may be an underestimation!
Not
every product or logo, however, will automatically result
in huge sales. In fact, for every successful license there
are hundreds that go by the wayside. Failures are often
the result of under funding, incorrectly reading the
market and /or a lack of patience. Ninja Turtles, for
example, took almost three years to catch on.
As a
licensing attorney, I will review your potential property,
and with the aid of market research advise you as to the
viability of the property. Should we conclude that your
property could be commercially viable I can assist you in
various ways.
Should
you wish to market your property yourself, or through a
licensing company that you are familiar with, I can act as
legal counsel. This can entail preparing your agreement
with the licensing company, preparing and negotiating the
actual licensing agreements with manufacturers, assisting
with trademark and / or copyright issues, and of course
any litigation that might ensue.
